Explicación Simple

Si manejas un vehículo y dañas la carretera, tú eres responsable de pagar por los daños. Si no eres el dueño del vehículo pero lo manejas con permiso, tanto tú como el dueño deben pagar.

Es como si prestaras tu bicicleta a un amigo y él la rompe mientras la usa. Tanto tú como tu amigo tendrían que asumir la responsabilidad por los daños.

Ejemplo Práctico

Imagina que Juan está manejando el camión de su amigo Luis con permiso. Al pasar por un puente, el camión es demasiado pesado y causa daños en la estructura. Tanto Juan como Luis serán responsables de pagar por las reparaciones.

SECTION 56-5-4230. Liability for damages to highway or highway structure. Any person driving or moving any vehicle, object or contrivance upon any highway or highway structure shall be liable for all damages which such highway or structure may sustain as a result of any illegal operation, driving or moving of such vehicles, objects or contrivances or whether such damage is a result of operating, driving or moving any vehicle, object or contrivance weighing in excess of the maximum weights as provided in this article but authorized by special permit issued pursuant to Section 56-5-4170. Whenever such driver is not the owner of such vehicle, object or contrivance, but is so operating, driving or moving it with the express or implied permission of such owner, the owner and driver shall be jointly and severally liable for any such damage.
