Explicación Simple

Esta ley dice que si alguien quiere venderte un libro o revista, no puede obligarte a aceptar otro que sea considerado obsceno. También prohíbe que te amenacen si no lo aceptas. Si lo hacen, pueden meterse en problemas.

Es como si un amigo te dijera que solo puedes jugar al fútbol si también aceptas jugar al baloncesto, aunque no te guste. No debería obligarte a hacer algo que no quieres.

Ejemplo Práctico

Imagina que Laura tiene una tienda de libros. Un distribuidor le dice que solo le venderá libros nuevos si ella acepta vender revistas obscenas. Laura se niega, pero el distribuidor amenaza con no darle más libros. Esto es ilegal según esta ley.

Multa de hasta mil dólares o hasta un año de cárcel, o ambas.

SECTION 16-15-315. Condition on certain sales for resale or on franchising rights that obscene material be received for resale prohibited; penalties. No person shall, as a condition to any sale, allocation, consignment, or delivery for resale of any paper, magazine, book, periodical, publication, digital electronic file require that the purchaser or consignee receive for resale any other article, book, publication, or digital electronic file which is obscene within the meaning of Section 16-15-305 nor shall any person deny or threaten to deny any franchise or impose or threaten to impose any penalty, financial or otherwise, by reason of the failure or refusal of any person to accept the articles, books, publications, or digital electronic files, or by reason of the return thereof. A person who violates this section is guilty of a misdemeanor and, upon conviction, must be imprisoned for not more than one year or fined not more than one thousand dollars, or both.
