Si eres mecánico y te dicen que no puedes trabajar porque tu certificado fue suspendido, puedes pedirle a un juez que revise esa decisión. Tendrás que avisar a la autoridad con 60 días de anticipación para que se haga una audiencia.
Es como cuando un estudiante no pasa un examen y tiene el derecho de pedir una revisión del resultado. Si el profesor se da cuenta de que hubo un error, el estudiante puede aprobar.
Imagina que Juan, un mecánico, pierde su certificado porque se le acusó de hacer un mal trabajo. Juan puede apelar esa decisión, avisar a la oficina correspondiente con un mes y medio de anticipación, y luego un juez escuchará su caso para decidir si puede seguir trabajando.
(c) Judicial review.-- Any mechanic whose certificate has been denied or suspended under this chapter shall have the right to appeal to the court vested with jurisdiction of such appeals by or pursuant to Title 42 (relating to judiciary and judicial procedure). The court shall set the matter for hearing upon 60 days' written notice to the department and take testimony and examine into the facts of the case and determine whether the petitioner is entitled to certification or is subject to suspension of the certification under the provisions of this chapter. Puedes apelar la decisión ante un juez. Debes notificar a la autoridad con 60 días de anticipación para que se programe la audiencia.
Tienes 60 días para informar a la autoridad antes de que se realice la audiencia sobre tu apelación.
En la audiencia, un juez escuchará tu caso, revisará las pruebas y decidirá si vuelves a tener tu certificación o si se mantiene la suspensión.
