Si alguien comete un delito y no estaba bien de su cabeza en ese momento, puede intentar demostrarlo para no ser castigado. Tienen que mostrar pruebas de que no sabían lo que hacían o que estaba mal.

Es como cuando un niño rompe un juguete sin querer, pero no entiende que lo que hizo está mal. Si el niño no sabe que romper el juguete es algo malo, tal vez no lo castiguemos.

Imagina que Juan, que sufre de una enfermedad mental, se encuentra en una situación confusa y, sin querer, causa daño a alguien. En su juicio, sus abogados presentan pruebas de que Juan no sabía que lo que hacía estaba mal debido a su condición mental, lo que podría ayudarle a evitar una condena severa.

18 Pa.C.S. 1982 - Amendment Cross References.Section 314 is referred to in section 9727 of Title 42 (Judiciary and Judicial Procedure). 18 Pa.C.S. 1982 - Amendment § 315. Insanity. (a) General rule. --The mental soundness of an actor engaged in conduct charged to constitute an offense shall only be a defense to the charged offense when the actor proves by a preponderance of evidence that the actor was legally insane at the time of the commission of the offense. (b) Definition. --For purposes of this section, the phrase "legally insane" means that, at the time of the commission of the offense, the actor was laboring under such a defect of reason, from disease of the mind, as not to know the nature and quality of the act he was doing or, if the actor did know the quality of the act, that he did not know that what he was doing was wrong. Section 4 of Act 286 provided that Act 286 shall apply to all indictments or informations filed on or after the effective date of Act 286.
