Imagina que Juan roba un televisor de una tienda. Mientras lo hace, rompe varios estantes que valen mucho más que el televisor. Según esta ley, el daño que causó al romper los estantes se considera un factor serio para penalizarlo más duramente.
Las penas pueden ser más severas si se demuestra un impacto desproporcionado durante el robo.
ORS 164.063 Disproportionate impact ORS 164.063 Disproportionate impact rules Text Annotations (1) As used in this section, “disproportionate impact” means that, in a case of theft in the first degree under ORS 164.055 (Theft in the first degree) or aggravated theft in the first degree under ORS 164.057 (Aggravated theft in the first degree) : (a) The offender caused damage to property during the commission of the theft and the cost to restore the damaged property to the condition the property was in immediately before the theft is more than three times the value of the property that was the subject of the theft; or (b) The theft of the property creates a hazard to public health or safety or the environment. (2) The Oregon Criminal Justice Commission shall adopt rules that establish disproportionate impact as an aggravating factor that a court may consider as a substantial and compelling reason to impose an upward departure from a presumptive sentence under the rules of the commission. Es cuando el daño causado durante un robo es mucho mayor que el valor de lo robado, o cuando el robo pone en riesgo la salud o la seguridad pública.
Si se determina que hubo un impacto desproporcionado, el juez puede decidir castigar al ladrón con una pena más severa.
Principalmente se refiere a robos de primer grado y robos agravados, donde se causan daños significativos o riesgos a la comunidad.
