Esta ley dice que es un crimen ver o compartir videos de niños en situaciones sexuales. Si alguien hace esto para satisfacer sus deseos, está cometiendo un delito serio.
Es como si alguien comprara un libro que solo tiene historias tristes para sentirse mal. Hacerlo con videos de niños es aún más grave y dañino.
Imagina que Juan, un hombre de 30 años, paga para ver un video donde un niño es explotado sexualmente. Aunque Juan no hizo el video, al verlo y pagar por ello, está fomentando el abuso y podría ser arrestado por esta ley.
Es un delito menor de clase A, lo que puede llevar a multas y hasta un año de cárcel.
ORS 163.687 Encouraging child sexual abuse in the third degree ORS 163.687 Encouraging child sexual abuse in the third degree Text Annotations (1) A person commits the crime of encouraging child sexual abuse in the third degree if the person: (a)(A)(i) Knowingly possesses or controls, or knowingly accesses with the intent to view, a visual recording of sexually explicit conduct involving a child for the purpose of arousing or satisfying the sexual desires of the person or another person; or (ii) Knowingly pays, exchanges or gives anything of value to obtain or view a visual recording of sexually explicit conduct involving a child for the purpose of arousing or satisfying the sexual desires of the person or another person; and (B) Knows or fails to be aware of a substantial and unjustifiable risk that the creation of the visual recording of sexually explicit conduct involved child abuse; or (b) Intentionally left blank —Ed. (A) Knowingly pays, exchanges or gives anything of value to observe sexually explicit conduct by a child or knowingly observes, for the purpose of arousing or gratifying the sexual desire of the person, sexually explicit conduct by a child; and (B) Knows or fails to be aware of a substantial and unjustifiable risk that the conduct constitutes child abuse. Significa ayudar o contribuir a que haya abuso sexual hacia niños, ya sea viendo, compartiendo o pagando por ese tipo de contenido.
Si sabes que existe un riesgo de que el video involucre abuso, podrías ser considerado culpable. La ignorancia no siempre es una defensa en este caso.
Si te encuentran culpable de fomentar el abuso sexual infantil en tercer grado, podrías enfrentar una multa y hasta un año de cárcel, ya que es un delito menor de clase A.
