Explicación Simple

Esta ley trata sobre el uso de internet para hacer cosas malas con los niños. Si alguien habla con un menor creyendo que es mayor, puede tener una defensa, pero no si está hablando con un policía disfrazado. Todo esto es muy serio y puede tener graves consecuencias.

Es como si alguien jugara un juego de mesa y pensara que las reglas son diferentes. Si no sigue las reglas del juego, aunque crea que está correcto, terminará perdiendo y enfrentando consecuencias.

Ejemplo Práctico

Imagina que Juan, de 20 años, comienza a chatear en línea con alguien que dice ser de 17. Si Juan cree que la persona es mayor, podría intentar defenderse si se enfrenta a la ley. Sin embargo, si esa persona en realidad es un policía encubierto, Juan no podrá usar esa defensa y podría enfrentar cargos serios.

ORS 163.434 Provisions applicable to online sexual corruption of a child ORS 163.434 Provisions applicable to online sexual corruption of a child Text Annotations (1) It is an affirmative defense to a prosecution for online sexual corruption of a child in the first or second degree that the person was not more than three years older than the person reasonably believed the child to be. (2) It is not a defense to a prosecution for online sexual corruption of a child in the first or second degree that the person was in fact communicating with a law enforcement officer, as defined in ORS 163.730 (Definitions for ORS 30.866 and 163.730 to 163.750) , or a person working under the direction of a law enforcement officer, who is 16 years of age or older. (3) Online sexual corruption of a child in the first or second degree is committed in either the county in which the communication originated or the county in which the communication was received.
