Explicación Simple

En Oregón, un policía o incluso un ciudadano puede arrestar a alguien sin una orden si hay buenas razones para pensar que esa persona ha cometido un crimen serio en otro estado. Después del arresto, la persona debe ser llevada rápidamente ante un juez para explicar por qué fue arrestada.

Es como si un maestro te detuviera en la escuela porque alguien de otra clase te acusó de hacer trampa en un examen. El maestro tiene que llevarte a la dirección para que se aclare la situación.

Ejemplo Práctico

Imagina que Juan está en Oregón y un policía recibe un aviso de que Juan tiene una orden de arresto en California por un robo. El policía puede arrestar a Juan en ese momento, pero debe llevarlo ante un juez lo más pronto posible para que se explique por qué lo arrestaron.

ORS 133.805 Arrest without warrant ORS 133.805 Arrest without warrant Text Annotations   1 The arrest of a person may be lawfully made also by an officer or a private citizen without a warrant, upon reasonable information that the accused stands charged in the courts of another state with a crime punishable by death or imprisonment for a term exceeding one year, but when so arrested the accused must be taken before a judge or magistrate with all practicable speed and complaint must be made against the accused under oath setting forth the ground for the arrest as in ORS 133.803 (Arrest prior to requisition) ; and thereafter the answer of the accused shall be heard as if the accused had been arrested on a warrant.
