Cuando alguien es arrestado y le quitan su dinero o cosas valiosas, la policía o los carceleros deben darle un recibo. Este recibo es como un comprobante que dice qué cosas le quitaron, y debe guardarlo hasta que le devuelvan sus cosas.
Es como cuando dejas tu abrigo en un guardarropa y te dan un ticket. Ese ticket es tu prueba de que tu abrigo está seguro y te lo devolverán cuando lo pidas.
Imagina que Juan es arrestado y la policía le quita su teléfono y su billetera. El oficial le da a Juan un recibo que dice que tiene sus cosas. Si Juan no puede firmar, el oficial se asegura de que le den el recibo más tarde. Luego, cuando Juan es liberado, puede presentar el recibo para recuperar sus pertenencias.
Si un oficial no sigue esta regla, puede enfrentar un cargo de delito menor de Clase B.
ORS 133.455 Receipts for property taken from person in custody ORS 133.455 Receipts for property taken from person in custody penalty Text Annotations 4 (1) Whenever any jailer, peace officer or health officer takes or receives any money or other valuables from any person in custody for safekeeping or for other purposes, the officer or jailer receiving such valuables or money forthwith shall tender one of duplicate receipts for the property being surrendered to the person in custody. If possible, the person in custody shall countersign both the original and duplicate receipts. If the person is unable to sign the receipts or receive the duplicate thereof, the same shall be signed by and delivered to the person when reasonably possible. A file of the original receipts shall be kept for at least six months after the money or valuables have been returned to the person in custody, the agent or representative of the person or other person entitled to the same. Si no te dan un recibo, debes informar al oficial a cargo y pedirlo. Es importante tener un comprobante de tus pertenencias.
Cualquier dinero o bien valioso que te quiten, como joyas o dispositivos electrónicos, debe ser documentado con un recibo.
El oficial debe darte el recibo lo antes posible. Si no lo hacen, podrías presentar una queja sobre el incumplimiento de esta ley.
