Esta sección de la ley explica qué es un tribunal de juicio y cómo funcionan las órdenes de arresto. Básicamente, un tribunal es el lugar donde se resuelven los casos de delitos y una orden de arresto es un documento que dice que alguien debe ser detenido por la policía.

Es como cuando un maestro dice que un estudiante tiene que ir a la oficina del director. El maestro da la orden y la oficina es donde se toman decisiones sobre el comportamiento del estudiante.

Ejemplo Práctico

Imagina que Juan es acusado de robar una tienda. Un juez en el tribunal de juicio revisa el caso de Juan y puede aceptar su declaración de culpabilidad o inocencia. Si decide que Juan debe ser arrestado, emite una orden de arresto para que la policía lo lleve ante el tribunal.

(12) “Trial court” means a court which by law has jurisdiction over an offense charged in an accusatory instrument and has authority to accept a plea thereto, or try, hear or otherwise dispose of a criminal action based on the accusatory instrument. (13) “Ultimate trial jurisdiction” means the jurisdiction of a court over a criminal action or proceeding at the highest trial level. (14) “Warrant of arrest” means a process of a court, directing a peace officer to arrest a defendant and to bring the defendant before the court for the purpose of arraignment upon an accusatory instrument filed therewith by which a criminal action against the defendant has been commenced.
