Explicación Simple

Cuando alguien tiene un accidente y hace un depósito de dinero, ese dinero se guarda para pagar si alguien demanda. Si después se demuestra que no es responsable o se llega a un acuerdo, le devuelven el dinero.

Es como cuando prestas tu bicicleta a un amigo y le pides que te dé una garantía. Si te la devuelve en buen estado, le devuelves la garantía. Si no, usas esa garantía para arreglarla.

Ejemplo Práctico

Imagina que Juan tiene un accidente de coche y deposita $5,000 como garantía. Después de investigar, se descubre que el accidente no fue su culpa. Juan presenta la evidencia y le devuelven su dinero porque se comprobó que no tiene que pagar nada.

§ 20-279.10. Custody, disposition and return of security; escheat. (a) Security deposited in compliance with the requirements of this Article shall be placed by the Commissioner in the custody of the State Treasurer and shall be applicable only to the payment of a judgment or judgments rendered against the person or persons on whose behalf the deposit was made, for damages arising out of the accident in question in an action at law, begun not later than one year after the date of such accident, or within one year after the date of deposit of any security under subdivision (3) of G.S. 20-279.7, or to the payment in settlement, agreed to by the depositor, of a claim or claims arising out of such accident. Such deposit or any balance thereof shall be returned to the depositor or his personal representative when evidence satisfactory to the Commissioner has been filed with him that there has been a release from liability, or a final adjudication of nonliability, or a duly acknowledged agreement, in accordance with subdivision (4) of G.S. 20-279.6, or a settlement accepted by the Commissioner as provided in subdivision (5) of G.S. 20-279.6, or a conviction accepted by the Commissioner as provided in subdivision (6) of G.S. 20-279.6, or whenever, after the expiration of one year from the date of the accident, or from the date of deposit of any security under subdivision (3) of G.S.
