Si una persona en prisión necesita atención médica y se le libera, debe seguir ciertas reglas. Estas reglas aseguran que reciba el tratamiento adecuado y que no se salte ninguna cita médica.
Es como cuando un estudiante se enferma y se queda en casa. Para poder regresar a la escuela, debe seguir un plan de recuperación y tener permiso para ser visitado por un médico.
Imagina que Juan está en prisión y se enferma gravemente. La Comisión decide liberarlo para que reciba tratamiento, pero le dice que debe seguir un plan médico, presentarse a chequeos y permitir que un oficial lo visite en su casa. Si Juan no cumple con estas condiciones, podría ser regresado a prisión.
Si no se cumplen las condiciones, el recluso puede ser devuelto a prisión para una audiencia sobre su revocación.
§ 15A-1369.4. Conditions of medical release. (a) The Commission shall set reasonable conditions upon an inmate's medical release that shall apply through the date upon which the inmate's sentence would have expired. These conditions shall include all of the following: (1) That the released inmate's care be consistent with the care specified in the medical release plan as approved by the Commission. (2) That the released inmate shall cooperate with and comply with the prescribed medical release plan and with reasonable requirements of medical providers to whom the released inmate is to be referred to continued treatment. (3) That the released inmate shall be subject to supervision by the Division of Community Supervision of the Department of Adult Correction and shall permit officers from the Division to visit the inmate at reasonable times at the inmate's home or elsewhere. (4) That the released inmate shall comply with any conditions of release set by the Commission. (5) That the Commission shall receive periodic assessments from the inmate's treating physician. (b) The Commission shall promptly order an inmate returned to the custody of the Division to await a revocation hearing if the Commission receives credible information that an inmate has failed to comply with any reasonable condition set upon the inmate's release.
La liberación médica es cuando un recluso sale de prisión por razones de salud, para recibir tratamiento médico adecuado.
Si no cumples con las condiciones, la Comisión puede decidir que regreses a prisión para esperar una audiencia sobre tu caso.
La supervisión de tu tratamiento médico estará a cargo de la División de Supervisión Comunitaria del Departamento de Corrección de Adultos.
