Es como si te prestan un libro y, sin que lo sepas, alguien lo toma y no te lo devuelve. Si encuentras el libro después de un tiempo, puedes pedirlo de vuelta, pero solo si actúas rápido y demuestras que no sabías que se lo habían llevado.
Imagina que Juan tiene una colección de discos. La policía los incauta porque creen que son parte de un caso ilegal. Juan no sabía nada de eso y, al enterarse, presenta una solicitud para que le devuelvan sus discos. Como cumplió con los requisitos, puede recuperar su colección.
property, the justice of the supreme court may restore said forfeited property upon such terms and conditions as he deems reasonable and just, if the petitioner establishes either of the affirmative defenses set forth in subdivision five of this section and that the petitioner was without personal or actual knowledge of the forfeiture proceeding.
