Explicación Simple

Si tienes problemas con tu vecino sobre dónde termina tu terreno y empieza el suyo, puedes pedir ayuda a un tribunal. El tribunal nombrará a personas que son imparciales para que midan y digan dónde están las líneas correctas.

Es como cuando dos amigos discuten sobre dónde debe estar la línea en un juego de fútbol. Un árbitro imparcial puede decidir dónde trazar esa línea para que todos jueguen justo.

Ejemplo Práctico

Imagina que Ana y Luis son vecinos y tienen un árbol que está justo en la línea entre sus propiedades. Ana piensa que el árbol está en su terreno, mientras que Luis cree que le pertenece a él. Deciden ir al tribunal, que nombra a tres comisionados para que midan y determinen la línea correcta entre sus terrenos.

2A:28-1. When any dispute arises between the owners of adjoining lands as to the location of any dividing line or lines between such lands, the Superior Court may, on application of either owner on notice to the other, appoint three disinterested commissioners, one of whom shall be a practical surveyor, who shall fix, ascertain and regulate such lines. Duties and powers of commissioners Before entering upon their duties the commissioners shall take and subscribe an oath that they and each of them will fairly and impartially and to the best of their judgment ascertain the true location of the lines in dispute. The commissioners may enter upon any lands for the purpose of ascertaining and deciding the location of the disputed lines, and they shall have power to examine witnesses under oath and to inquire fully into the questions in dispute. The commissioners shall file a report thereof with the court within such time as the court shall prescribe and, unless otherwise ordered by the court, the report shall be final and conclusive against all of the parties and their heirs and assigns.
