Explicación Simple

Si alguien comete un delito menor, la cantidad de dinero que tiene que pagar para salir de la cárcel no puede ser más del doble de la multa más alta que le pueden imponer. Para ciertos delitos específicos, esa cantidad puede ser aún mayor.

Es como cuando en un juego de mesa tienes que pagar una penalización. Si la penalización es de 10 puntos, no puedes pagar más de 20 puntos para salir de la situación en la que estás.

Ejemplo Práctico

Imagina que Juan fue arrestado por manejar bajo la influencia del alcohol. La multa más alta para este delito es de $500. Entonces, el juez podría fijar su fianza en un máximo de $1,000 para que Juan pueda salir de la cárcel mientras espera su juicio.

Except as provided in subdivision 2 or 3, the maximum cash bail that may be required for a person charged with a misdemeanor or gross misdemeanor offense is double the highest cash fine that may be imposed for that offense. (a) For offenses under sections169.09,169A.20,171.24, subdivision 5, and609.525, the maximum cash bail that may be required for a person charged with a misdemeanor or gross misdemeanor violation is quadruple the highest cash fine that may be imposed for the offense. (b) Unless the court imposes the conditions of release specified in section169A.44, the court must impose maximum bail when releasing a person from detention who has been charged with violating section169A.20if the person has three or more prior impaired driving convictions within the previous ten years. As used in this subdivision, "prior impaired driving conviction" has the meaning given in section169A.03. For offenses under sections609.224and609.377, the maximum cash bail that may be required for a person charged with a misdemeanor or gross misdemeanor violation is six times the highest cash fine that may be imposed for the offense. For offenses under sections518B.01,609.2242, and629.75, the maximum cash bail that may be required for a person charged with a misdemeanor or gross misdemeanor violation is ten times the highest cash fine that may be imposed for the offense.
