Explicación Simple

Si alguien va a prisión y luego su condena se anula, y comete otro delito relacionado, su nueva pena se reduce por el tiempo que ya pasó en prisión. Además, si estuvo en prisión antes de que lo envíen a cumplir su nueva pena, ese tiempo cuenta también para reducirla.

Es como cuando cocinas un platillo y, si ya usaste ciertos ingredientes en una receta anterior, no necesitas comprarlos de nuevo. Así, el tiempo en prisión anterior ayuda a que la nueva condena sea más corta.

Ejemplo Práctico

Imagina que Juan fue condenado a un año de prisión por un delito menor y, después de cumplir seis meses, su condena fue anulada. Luego, comete un nuevo delito relacionado. En su nueva sentencia, solo tendría que cumplir seis meses, ya que esos seis meses anteriores se restan de su nueva pena.

When a person has been imprisoned pursuant to a conviction which is set aside and is thereafter convicted of a crime growing out of the same act or omission, the period of imprisonment to which the person is sentenced is reduced by the period of the prior imprisonment and the time earned thereby in diminution of sentence. A sentence of imprisonment upon conviction of a felony is reduced by the period of confinement of the defendant following the conviction and before the defendant's commitment to the commissioner of corrections for execution of sentence unless the court otherwise directs. When a person is to be committed to the commissioner, the person's probation officer must provide to the court, prior to the sentencing hearing, the amount of time the person has in credit for prior imprisonment.
