Explicación Simple

Si ves a alguien con problemas en su auto y quieres ayudar, puedes parar tu vehículo sin que te multen. Pero debes asegurarte de que esa persona no esté siendo ayudada ya y seguir algunas reglas de seguridad.

Es como si estuvieras en una cena y alguien se atraganta; puedes dejar tu plato para ayudarlo, siempre y cuando no estés interrumpiendo a otros y sigas las normas de la mesa.

Imagina que Juan está manejando y ve a una mujer, Ana, con el capó de su auto levantado. Juan se detiene para ayudarla, asegurándose de que nadie más ya la esté asistiendo. Después de verificar que Ana necesita ayuda, se asegura de estacionar su auto de forma segura y al poco tiempo, un oficial le pide que se retire, lo cual hace sin problemas.

(a) A person who stops or parks that person's motor vehicle on any highway or street for the sole purpose of aiding another motorist who signals for assistance by raising the hood of the vehicle or displaying a flag, flare or similar signal is not in violation of any law, ordinance, or rule prohibiting the stopping or parking of a motor vehicle, and no peace officer shall issue a traffic ticket therefor if: (1) the motorist in distress is not already being given aid or assistance; (2) the person takes reasonable safety precautions in stopping and parking the vehicle, and conforms with other laws regulating the stopping and parking of vehicles; (3) the person is not in violation of traffic laws or rules other than the prohibition against stopping and parking; and (4) the person promptly leaves the scene if directed to leave by a peace officer.
