Si tienes un dispositivo que necesita ser aprobado por el gobierno, tienes 90 días para demostrar que cumple con las reglas. Si no lo haces, el gobierno puede quitar la aprobación y pedir que se reemplacen los dispositivos que no cumplen.
Es como si compraras un coche nuevo y el concesionario te diera 90 días para demostrar que el coche cumple con todas las normas de seguridad. Si no lo haces, el concesionario podría pedirte que devuelvas el coche.
Imagina que Juan tiene un negocio de venta de alarmas de seguridad. Recibió una notificación de que sus alarmas deben ser revisadas. Si no puede demostrar que cumplen con las normas en 90 días, el gobierno suspenderá la venta de esas alarmas y Juan tendrá que reemplazarlas por otras que sí cumplan.
Si no se cumplen los requisitos, la aprobación del dispositivo puede ser suspendida o revocada.
(b) If, at the expiration of 90 days after such notice, the person holding the certificate of approval for such device has failed to satisfy the commissioner of public safety that the approved device as thereafter to be sold meets the requirements of this chapter, the commissioner of public safety shall suspend or revoke the approval issued therefor until or unless such device is resubmitted to and retested by an authorized testing agency and is found to meet the requirements of this chapter, and may require that all such devices sold since the notification following the hearing be replaced with devices that do comply with the requirements of this chapter. The commissioner of public safety may at the time of the retest purchase in the open market and submit to the testing agency one or more sets of such approved devices, and if such device upon such retest fails to meet the requirements of this chapter, the commissioner of public safety may refuse to renew the certificate of approval of such device. Si no cumples en ese plazo, el gobierno puede suspender la aprobación de tu dispositivo y pedir que se reemplacen los que no cumplen.
Debes resubir el dispositivo a una agencia de pruebas autorizada para que lo evalúen y verifiquen que cumple con los requisitos establecidos.
El gobierno puede exigir que todos los dispositivos vendidos desde la notificación sean reemplazados por otros que sí cumplan con las normas.
