Revocación de Certificado de Aprobación de Dispositivos de Iluminación

Explicación Simple

Si un dispositivo de iluminación no cumple con las reglas, el encargado puede pedirle al vendedor que lo demuestre. Si no lo hace en 90 días, se le puede quitar la aprobación y tendrá que reemplazar los que vendió.

Es como cuando un profesor revisa un trabajo y te dice que corrijas algo. Si no lo haces a tiempo, tu tarea no será aceptada y tendrás que rehacerla.

Ejemplo Práctico

Imagina que Juan vende bombillas en su tienda. El administrador descubre que sus bombillas no son seguras y le da 30 días para demostrar que cumplen con las normas. Como Juan no lo hace, después de 90 días, pierde la aprobación y debe cambiar todas las bombillas que vendió por otras que sí sean seguras.

Penalidades

Si no se cumple con los requisitos, se puede revocar la aprobación del dispositivo y se deben reemplazar los que se hayan vendido.

Maryland Transportation Code Section 22-232 (2023) - Revocation of Certificate of Approval on Lighting Devices (a) When the Administrator has reason to believe that an approved device, as being sold commercially, does not comply with the requirements of this title, after giving 30 days’ previous notice to the person holding the certificate of approval for the device in this State, he may conduct a hearing on the question of compliance of the approved device. After the hearing, the Administrator shall determine whether the approved device meets the requirements of this title. If the device does not meet the requirements of this title he shall give notice to the person holding the certificate of approval for the device in this State. (b) If, at the expiration of 90 days after the notice, the person holding the certificate of approval for the device has failed to satisfy the Administrator that the approved device as thereafter to be sold meets the requirements of this title, the Administrator shall suspend or revoke the approval issued for the device until the device is resubmitted to and retested by an authorized testing agency and is found to meet the requirements of this title, and the Administrator may require that all the devices sold since the notification following the hearing be replaced with devices that do comply with the requirements of this title.
