Esta ley dice que nadie puede tocar a otra persona de manera sexual sin su permiso. También protege a personas que no pueden dar su consentimiento, como menores o personas con discapacidades.
Es como si alguien entrara a tu casa sin tu permiso y comenzara a mirar tus cosas. Así como no quieres que nadie toque tus pertenencias sin tu consentimiento, lo mismo aplica para el cuerpo de las personas.
Imagina que Juan, un hombre de 25 años, se acerca a Ana, una chica de 15 años, en una fiesta. Si Juan intenta tener relaciones sexuales con Ana, está cometiendo un delito porque ella es menor de 16 años y no puede dar su consentimiento legal.
Maryland Criminal Law Code Section 3-307 (2023) - Sexual Offense in the Third Degree (a) A person may not: (1) (i) engage in sexual contact with another without the consent of the other; and (ii) 1. employ or display a dangerous weapon, or a physical object that the victim reasonably believes is a dangerous weapon; 2. suffocate, strangle, disfigure, or inflict serious physical injury on the victim or another in the course of committing the crime; 3. threaten, or place the victim in fear, that the victim, or an individual known to the victim, imminently will be subject to death, suffocation, strangulation, disfigurement, serious physical injury, or kidnapping; or 4. commit the crime while aided and abetted by another; (2) engage in sexual contact with another if the victim is a substantially cognitively impaired individual, a mentally incapacitated individual, or a physically helpless individual, and the person performing the act knows or reasonably should know the victim is a substantially cognitively impaired individual, a mentally incapacitated individual, or a physically helpless individual; (3) engage in sexual contact with another if the victim is under the age of 14 years, and the person performing the sexual contact is at least 4 years older than the victim; (4) engage in a sexual act with another if the victim is 14 or 15 years old, and the person performing the sexual act is at least 21 years old; or (5) engage in vaginal intercourse with another if the victim is 14
El contacto sexual incluye cualquier tipo de toque físico con intención sexual, como abrazar, besar o tocar de manera inapropiada. No importa si hay presión o amenazas, el consentimiento siempre es esencial.
Si la víctima tiene una discapacidad mental o física que le impide dar su consentimiento, la ley protege a esa persona. Cualquier contacto sexual en estas circunstancias se considera un delito grave.
La ley menciona que es un delito tener contacto sexual con alguien menor de 14 años si la persona que lo hace es al menos 4 años mayor. También se aplica a personas de 14 o 15 años si el agresor tiene 21 años o más.
