Explicación Simple

Si alguien comete un delito que no es violento, puede tener la opción de recibir ayuda en un programa de tratamiento que se basa en la fe. Si el juez y la persona están de acuerdo, pueden elegir este programa en lugar de otras opciones.

Es como elegir entre ir a un campamento de verano donde aprendes cosas buenas o quedarte en casa haciendo tareas. Si eliges el campamento y te comprometes a seguir las reglas, tendrás una mejor experiencia.

Imagina a Juan, quien fue detenido por un delito menor. Como no es violento, el juez le ofrece un programa de tratamiento residencial basado en la fe para ayudarlo con sus problemas de adicción. Juan acepta, firma un compromiso y se muda al programa, donde recibe apoyo y orientación.

218A.136 Utilization of faith-based residential treatment program -- Conditions. (1) An offender charged with a felony pursuant to this chapter who is not charged with a violent offense, who is eligible for diversion or deferred prosecution of his or her sentence, and whose diversion or deferred prosecution plan involves substance use disorder treatment may be afforded the opportunity to utilize a faith -based residential treatment program. (2) If an offender and judge support this faith -based residential treatment program, and the cost of the program is less than that of the substance u se disorder treatment that would otherwise be provided, then the court may approve the faith-based residential treatment program for a specified period of time. An offender shall sign a commitment to comply by the terms of the faith -based residential treat ment program. (3) If an offender violates the terms of the commitment he or she has signed with the faith-based residential treatment program, then the offender shall be returned to the court for additional proceedings.
