Authorization. (a) The Chief Judge of each judicial circuit may establish a veterans and servicemembers court program in compliance with the Problem-Solving Court Standards. The veterans and servicemembers court may, at the discretion of the Chief Judge, be a separate court or a program of a problem-solving court, including, but not limited to, a drug court, mental health court, or a court for individuals with either substance use, mental health, or co-occurring disorders. At the discretion of the Chief Judge, the Veterans and Servicemembers Court program may be operated in one or more counties in the Circuit, and allow veteran and servicemember defendants from all counties within the Circuit to participate. (b) Whenever the county boards of 2 or more counties within the same judicial circuit determine that a single veteran and servicemembers court program would best serve those counties, the county board of each such county may adopt a resolution to the effect that there shall be a single veteran and servicemembers court program serving those counties, and shall provide a copy of the resolution to the Chief Judge of the judicial circuit.
