Si alguien comete un delito en otro estado, puede ser llevado a ese estado para enfrentar cargos, incluso si no estaba allí. Pero si la persona estaba haciendo algo legal en su estado, no será extraditada a menos que se pruebe que estuvo allí en el momento del crimen.
Es como un jugador de fútbol que comete una falta en un partido en otro país. Aunque no esté en ese país, el árbitro puede pedir que el jugador regrese para enfrentar las consecuencias, pero solo si la falta fue grave y se cometió mientras estaba en el campo.
Imagina que Juan vive en Colorado y se entera de que su amigo Carlos cometió un robo en Texas, pero Carlos no estaba en Texas en ese momento. Si Texas pide a Colorado que lo entregue para que responda por el robo, Colorado puede hacerlo, siempre y cuando el robo también sea un delito en Colorado.
C.R.S. 16-19-107 – Extradition of persons not present where crime committed (1) The governor of this state may also surrender, on demand of the executive authority of any other state, any person in this state charged in such other state in the manner provided in section 16-19-104 with committing an act in this state, or in a third state, intentionally resulting in a crime in the state whose executive authority is making the demand, and the provisions of this article 19 that are not otherwise inconsistent apply to such cases, even though the accused was not in that state at the time of the commission of the crime and has not fled therefrom, provided the acts for which extradition is sought would be punishable by the laws of this state if the acts occurred in this state. (2) Except as required by federal law, the governor shall not surrender a person charged in another state as a result of the person engaging in a legally protected health-care activity, as defined in section 12-30-121 (1)(d), unless the executive authority of the demanding state alleges in writing that the accused was physically present in the demanding state at the time of the commission of the alleged offense and that thereafter the accused fled from the demanding state. La extradición es el proceso legal mediante el cual una persona acusada de un delito en un estado puede ser llevada a ese estado desde otro lugar para enfrentar cargos.
No se puede extraditar a alguien que estaba realizando una actividad legal en su estado y no se puede probar que estaba presente en el estado que pide la extradición.
El estado que pide la extradición debe demostrar que la persona acusada estaba presente en ese estado al momento del delito y que huyó después de cometerlo.
