Esta ley dice qué reglas se usan para manejar los pagos de apoyo familiar. Si alguien no paga lo que debe, se siguen ciertas leyes para resolverlo. También se asegura de que los pagos futuros se hagan correctamente.
Es como cuando en un juego de fútbol, el árbitro decide qué reglas seguir según de dónde vienen los equipos. Si un equipo es de un país donde se juega de una manera, usarán esas reglas para el partido.
María vive en Colorado y tiene una orden de apoyo de su exesposo, Juan, que vive en México. Si Juan no paga lo que debe, se aplican las reglas de México para calcular cuánto debe y cómo se paga. Pero, si un tribunal de Colorado decide que Juan debe más, se usarán las leyes de México para que cumpla con esos pagos.
C.R.S. 14-5-604 – Choice of law (a) Except as otherwise provided in subsection (d) of this section, the law of the issuing state or foreign country governs: (1) The nature, extent, amount, and duration of current payments under a registered support order; (2) The computation and payment of arrearages and accrual of interest on the arrearages under the support order; and (3) The existence and satisfaction of other obligations under the support order. (b) In a proceeding for arrears under a registered support order, the statute of limitation of this state, or of the issuing state or foreign country, whichever is longer, applies. (c) A responding tribunal of this state shall apply the procedures and remedies of this state to enforce current support and to collect arrears and interest due on a support order of another state or a foreign country registered in this state. (d) After a tribunal of this state or another state determines which is the controlling order and issues an order consolidating arrears, if any, a tribunal of this state shall prospectively apply the law of the state or foreign country issuing the controlling order, including its law on interest on arrears, on current and future support, and on consolidated arrears. Si tienes una orden de apoyo de otro estado, las leyes de ese estado se aplican para determinar los pagos y deudas. Colorado seguirá las reglas que esa orden estableció.
Un tribunal revisará las órdenes y decidirá cuál es la que tiene prioridad, aplicando sus propias leyes para futuros pagos.
El tiempo para reclamar deudas puede ser el más largo entre las leyes de Colorado y las del estado o país que emitió la orden de apoyo.
