Explicación Simple

Si conduces un carro y tienes mucho alcohol en la sangre, pueden quitarte el derecho a manejar. Esto es especialmente serio si eres menor de 21 años o si ya has tenido problemas anteriores por manejar ebrio.

Es como si te dejaran jugar en un equipo de fútbol, pero si no sigues las reglas, te sacan del juego hasta que demuestres que puedes comportarte.

Imagina que Juan, de 20 años, sale a una fiesta y decide manejar después de tomar algunas cervezas. La policía lo detiene y descubre que tiene un nivel de alcohol en sangre de 0.02%. En este caso, le suspenden la licencia de inmediato porque es menor de edad y no puede tener alcohol al conducir.

Vehicle Code - VEH Section 13353.2 Vehicle Code - VEH DIVISION 6. DRIVERS' LICENSES [12500 - 15326] ( Heading of Division 6 amended by Stats. 1961, Ch. 1615. ) CHAPTER 2. Suspension or Revocation of Licenses [13100 - 13559] ( Chapter 2 enacted by Stats. 1959, Ch. 3. ) ARTICLE 3. Suspension and Revocation by Department [13350 - 13392] ( Article 3 enacted by Stats. 1959, Ch. 3. ) 13353.2. (a) The department shall immediately suspend the privilege of a person to operate a motor vehicle for any one of the following reasons: (1) The person was driving a motor vehicle when the person had 0.08 percent or more, by weight, of alcohol in his or her blood. (2) The person was under 21 years of age and had a blood-alcohol concentration of 0.01 percent or greater, as measured by a preliminary alcohol screening test, or other chemical test. (3) The person was driving a vehicle that requires a commercial driver’s license when the person had 0.04 percent or more, by weight, of alcohol in his or her blood. (4) The person was driving a motor vehicle when both of the following applied: (A) The person was on probation for a violation of Section 23152 or 23153. (B) The person had 0.01 percent or more, by weight, of alcohol in his or her blood, as measured by a preliminary alcohol screening test or other chemical test. (b) The notice of the order of suspension under this section shall be served on the person by a peace officer pursuant to Section 13382 or 13388.
