Explicación Simple

Si tienes un animal que puede ser peligroso y no lo cuidas bien, puedes meterte en problemas si lastima a alguien. Si esa persona hizo todo lo posible para estar segura, tú serías responsable.

Es como si tuvieras una estufa encendida sin supervisarla. Si alguien se quema porque no la cuidaste, tú serías el responsable de ese accidente.

Ejemplo Práctico

Imagina que Juan tiene un perro que le ladra a la gente. Un día, Juan deja que el perro salga sin correa y el perro muerde a un niño que estaba caminando. Como Juan sabía que su perro podía ser peligroso y no tomó precauciones, podría enfrentar consecuencias legales.

Penalidades

Puede ser un delito menor o un delito mayor, dependiendo de si hay lesiones graves o muerte.

Penal Code - PEN PART 1. OF CRIMES AND PUNISHMENTS [25 - 680.4] ( Part 1 enacted 1872. ) TITLE 10. OF CRIMES AGAINST THE PUBLIC HEALTH AND SAFETY [369a - 402c] ( Title 10 enacted 1872. ) 399. (a) If any person owning or having custody or control of a mischievous animal, knowing its propensities, willfully suffers it to go at large, or keeps it without ordinary care, and the animal, while so at large, or while not kept with ordinary care, kills any human being who has taken all the precautions that the circumstances permitted, or which a reasonable person would ordinarily take in the same situation, is guilty of a felony. (b) If any person owning or having custody or control of a mischievous animal, knowing its propensities, willfully suffers it to go at large, or keeps it without ordinary care, and the animal, while so at large, or while not kept with ordinary care, causes serious bodily injury to any human being who has taken all the precautions that the circumstances permitted, or which a reasonable person would ordinarily take in the same situation, is guilty of a misdemeanor or a felony.
