Explicación Simple

En un caso de delito menor, el acusado puede decir si es culpable o no, ya sea él mismo o su abogado. Si admite ser culpable, el juez puede investigar más para ver si el delito fue más grave de lo que se pensaba.

Es como si un estudiante entregara un examen y el maestro se da cuenta de que la pregunta era más difícil de lo que se pensaba, así que decide revisar el examen antes de ponerle una calificación.

Imagina que Juan fue acusado de un delito menor por robar una bicicleta. En la corte, Juan puede decir si es culpable de eso. Si lo admite, el juez podría querer hablar con testigos para ver si el delito fue peor, como si Juan realmente intentó robar un auto.

In a misdemeanor case the plea of the defendant may be made by the defendant or by the defendant’s counsel. If such defendant pleads guilty, the court may, before entering such plea or pronouncing judgment, examine witnesses to ascertain the gravity of the offense committed; and if it appears to the court that a higher offense has been committed than the offense charged in the complaint, the court may order the defendant to be committed or admitted to bail, to answer any indictment which may be found against the defendant by the grand jury, or any complaint which may be filed charging the defendant with such higher offense.
