Explicación Simple

Si alguien es liberado bajo fianza y no va a su juicio, el juez puede emitir una orden de arresto. Si sí se presenta y recibe una sentencia o libertad condicional, su fianza se devuelve.

Es como cuando pides prestado el coche de un amigo y te prometes devolverlo a tiempo. Si no lo devuelves, tu amigo puede decidir no prestarte más su coche y podría pedirte que lo traigas de vuelta.

Ejemplo Práctico

Imagina que Juan fue liberado bajo fianza mientras esperaba su juicio por un cargo menor. Si decide no ir a la cita en la corte, el juez podría ordenar que lo arresten. Pero si Juan sí se presenta y recibe una sentencia leve, su fianza le será devuelta.

Penalidades

Si no te presentas, puedes perder la fianza y enfrentar una orden de arresto.

The Judgment [1191 - 1210.6] ( Chapter 1 enacted 1872. ) 1195. If the defendant has been released on bail, or has deposited money or property instead thereof, and does not appear for judgment when his personal appearance is necessary, the court, in addition to the forfeiture of the undertaking of bail, or of the money or property deposited, must, on application of the prosecuting attorney, direct the issuance of a bench warrant for the arrest of the defendant. If the defendant, who is on bail, does appear for judgment and judgment is pronounced upon him or probation is granted to him, then the bail shall be exonerated or, if money or property has been deposited instead of bail, it must be returned to the defendant or to the person or persons found by the court to have deposited said money or property on behalf of said defendant.
