Explicación Simple

Esta ley dice que si una persona menor de 18 años hace que otro menor venda o transporte drogas, puede ir a prisión. También se aplica si alguien le da drogas a un menor. Es una forma de proteger a los jóvenes de situaciones peligrosas.

Es como cuando un adulto le pide a un niño que le lleve un paquete sospechoso. Si el niño lo hace, no solo el adulto está mal, sino que también el niño se mete en problemas por seguir esa instrucción.

Imagina que Juan, de 17 años, le dice a su hermano menor, Luis, que le ayude a llevar unas pastillas a un amigo. Aunque Luis solo quería ayudar, Juan puede enfrentar serias consecuencias legales por usar a Luis para llevar drogas, y ambos podrían verse involucrados en problemas con la ley.

Health and Safety Code section 11354 Health and Safety Code section 11354 (a) Every person under the age of 18 years who in any voluntary manner solicits, induces, encourages, or intimidates any minor with the intent that the minor shall violate any provision of this chapter or Section 11550 , who hires, employs, or uses a minor to unlawfully transport, carry, sell, give away, prepare for sale, or peddle (1) any controlled substance specified in subdivision (b), (c), or (e), or paragraph (1) of subdivision (f) of Section 11054 , specified in paragraph (14), (15), or (20) of subdivision (d) of Section 11054 , or specified in subdivision (b) or (c) of Section 11055 , or specified in subdivision (h) of Section 11056 , or (2) any controlled substance classified in Schedule III, IV, or V which is a narcotic drug, or who unlawfully sells, furnishes, administers, gives, or offers to sell, furnish, administer, or give, any such controlled substance to a minor shall be punished by imprisonment in the state prison.
