Si un menor ha sido víctima de abuso sexual, puede decidir recibir atención médica sin que un adulto tenga que dar permiso. Los médicos deben intentar avisar a los padres, a menos que piensen que ellos fueron quienes hicieron daño.

Es como cuando un niño se hace daño jugando y puede decidir ir al médico por su cuenta, pero en este caso, si el daño fue causado por alguien cercano, el médico debe tener cuidado.

Imagina que Ana, una adolescente de 15 años, cuenta a su amiga que fue agredida. Ana puede ir al hospital y pedir ayuda médica sin que su madre tenga que estar presente, especialmente si no confía en ella para hablar de lo ocurrido. El médico intentará llamar a su madre para informarle, pero si sospecha que su madre podría estar involucrada, no lo hará.

MEDICAL TREATMENT [6900 - 6930] ( Part 4 enacted by Stats. 1992, Ch. 162, Sec. 10. ) CHAPTER 3. Consent by Minor [6920 - 6930] ( Chapter 3 enacted by Stats. 1992, Ch. 162, Sec. 10. ) 6928. (a) “Sexually assaulted” as used in this section includes, but is not limited to, conduct coming within Section 261, 286, or 287 of the Penal Code. (b) A minor who is alleged to have been sexually assaulted may consent to medical care related to the diagnosis and treatment of the condition, and the collection of medical evidence with regard to the alleged sexual assault. (c) The professional person providing medical treatment shall attempt to contact the minor’s parent or guardian and shall note in the minor’s treatment record the date and time the professional person attempted to contact the parent or guardian and whether the attempt was successful or unsuccessful. This subdivision does not apply if the professional person reasonably believes that the minor’s parent or guardian committed the sexual assault on the minor.
