28-2152 . Registration in county of residence; violation; classification; civil penalty; fee transfer A. A person who registers a motor vehicle belonging to the person or leased to the person in a county other than the county where the person maintains the person's permanent and actual residence or at a place within the county that is outside the vehicle emissions control area with intent to evade title 49, chapter 3, article 5 is guilty of a class 2 misdemeanor and is subject to a fine of no more than one hundred dollars. B. A lessee of a vehicle titled in the name of a lessor shall register the vehicle in the county where the lessee resides. The lessee shall provide documentation satisfactory to the director that the person is the lessee of the vehicle and resides in the county in which the person applies for registration of the vehicle. C. A person who registers a motor vehicle belonging to the person or leased to the person in a county other than the county where the person maintains the person's permanent and actual residence or at a place within the county that is outside the vehicle emissions control area is responsible for a civil violation and is subject to a civil penalty of no more than one hundred dollars. D. A county assessor who registers a motor vehicle illegally for a person not residing in the county shall transfer monies collected and retained by the county in connection with the registration to the county assessor of the county of the person's permanent and actual residence.
