Explicación Simple

Cuando compras un carro que tiene una deuda, el estado necesita saberlo. Si firmas un documento para obtener el título, le das permiso al estado para que registre esa deuda en sus archivos.

Es como cuando prestas un libro a un amigo, y le pones una etiqueta que dice que aún es tuyo. Así, si alguien más quiere el libro, sabe que no puede llevárselo hasta que tu amigo te lo devuelva.

Imagina que Juan quiere comprar un auto de María. María aún debe dinero por el auto, así que cuando Juan firma para obtener el título, el estado pone una nota que dice que el auto tiene una deuda. Juan no podrá recibir un nuevo título hasta que María pague la deuda o el banco que prestó el dinero acepte el cambio.

28-2132 . Indication of lien or encumbrance A. The department shall provide on the application for a certificate of title and the application for registration only a section that provides for the indication of a lien or encumbrance on the vehicle. B. The applicant's signature on the application for a certificate of title or the application for registration only is consent for the lien or encumbrance to be indicated by the department on its official certificate of title record for the vehicle. C. Except as provided in subsection D of this section and on receipt of the application as provided in this section, the department shall endorse on the application the date and hour it was received at the registering office of the department. D. The department shall not issue a new certificate of title if the outstanding certificate of title indicates an existing lien or encumbrance unless the lien or encumbrance has been satisfied or the lienor or encumbrancer has consented in writing or electronically to the transfer of title.
