USCA4 Appeal: 25-1354 Doc: 10 Filed: 08/25/2025 Pg: 1 of 2 UNPUBLISHED UNITED STATES COURT OF APPEALS FOR THE FOURTH CIRCUIT No. 25-1354 THERESA DENISE WOODBERRY, Plaintiff - Appellant, v. RUIZ FOOD; MCLEOD, Defendants - Appellees. Appeal from the United States District Court for the District of South Carolina, at Florence. Joseph Dawson, III, District Judge. (4:24-cv-07249-JD-TER) Submitted: August 21, 2025 Decided: August 25, 2025 Before WILKINSON, HARRIS, and RICHARDSON, Circuit Judges. Dismissed by unpublished per curiam opinion. Theresa Denise Woodberry, Appellant Pro Se. Unpublished opinions are not binding precedent in this circuit. USCA4 Appeal: 25-1354 Doc: 10 Filed: 08/25/2025 Pg: 2 of 2 PER CURIAM: Theresa Denise Woodberry seeks to appeal the district court’s order adopting the magistrate judge’s recommendation to dismiss Defendant McLeod from Woodberry’s civil action, and to allow her claims against Defendant Ruiz Food to proceed. This court may exercise jurisdiction only over final orders, 28 U.S.C. § 1291, and certain interlocutory and collateral orders, 28 U.S.C. § 1292; Fed. R. Civ. P. 54(b); Cohen v. Beneficial Indus. Loan Corp., 337 U.S. 541, 545-46 (1949). The order Woodberry seeks to appeal is neither a final order nor an appealable interlocutory or collateral order. Accordingly, we dismiss the appeal for lack of jurisdiction. We deny as moot Woodberry’s motion for an extension of time to file a pro se supplemental brief. We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before this court and argument would not aid the decisional process. DISMISSED 2
